Jason Ehrenberg Counsel

Jason Ehrenberg is Counsel and Litigation Lead at Holon Law Partners. His practice focuses on litigation and all aspects of employment law, including employee benefits law (ERISA) and higher education law. Mr. Ehrenberg is a skilled trial and appellate litigator. He has significant first-chair jury and bench trial experience. He has successfully represented individual and organizational clients in state and federal courts, in national and international arbitrations and mediations, and before state and federal administrative bodies

Mr. Ehrenberg’s current litigation case load includes several active matters in federal and state courts throughout the country – including his defense of corporate defendants in two federal employment discrimination lawsuits, his representation of a corporate plaintiff in a federal court litigation asserting civil RICO and state law contract and tort law claims, and his defense of the lead defendant in a federal criminal litigation in Maine (in which the Department of Justice has charged a licensed Maine medical cannabis cultivator and distributor with conspiracy to violate the Controlled Substances Act).

Other recent litigation involved Mr. Ehrenberg’s successful representation in a four-day bench trial of a company asserting violations of non-compete and non-solicitation agreements, his successful representation of the plaintiff in a seven-day jury trial involving complex medical malpractice claims, and his successful defense of multiple plan fiduciaries, a plan sponsor and a cash balance pension plan in an ERISA fiduciary litigation in which all claims against all defendants were dismissed after a six-day trial. Mr. Ehrenberg’s litigation experience also includes his successful defense of four military service members facing sexual assault charges before military tribunals (including the high-profile U.S. Naval Academy football court martial). Mr. Ehrenberg has been widely quoted on military justice matters in publications such as the Washington Post and New York Times and has appeared on television programs such as the CBS Morning News to discuss his views on the problems with the military’s handling of sexual assault cases.

Mr. Ehrenberg also has extensive experience in appellate litigation, having recently handled higher education, ERISA and employment matters in the United States Courts of Appeals for the Third, Fourth, Ninth, District of Columbia, and Federal Circuits.

Mr. Ehrenberg is a former AmLaw attorney with considerable experience counseling clients regarding issues arising under myriad federal and state employment law statutes and regulations. He assists employers with drafting position statements, employee handbooks and employer policies, as well as conducting investigations and providing employment and labor law advice and counsel. He also has vast expertise with, and knowledge of, all areas of ERISA and employee benefits law, and provides a wide range of services to all parties to employee benefits plans, including plan sponsors, plan participants, plan administrators, service providers and fiduciaries.

As part of his employment practice, Mr. Ehrenberg also regularly advises university administrators, professors, graduate students, and undergraduate students regarding all aspects of their relationships with institutes of higher education. He assists students and professors with Title IX investigations, tenure denials, academic dismissals and related matters. Jason also assists university administrators with severance disputes and the structuring of compensation packages.
